Sokolove Law Acts As Co-Counsel in Birth Injury Lawsuit Resulting in $7 Million Verdict

The court documents show that Danielle and John Bellerose brought the wrongful death lawsuit against two neonatologists, two nurse practitioners, and two registered nurses at Beth Israel Deaconess Medical Center who tended to the couple?s twin daughters Katherine and Alexis following their delivery on June 13, 2004. The twins? birth occurred two months prematurely, and Katherine - weighing only 2 pounds, 7 ounces - was immediately incubated and put in a neonatal intensive care.

While she was able to breathe on her own after four days, court documents show that Katherine developed necrotizing enterocolitis (NEC) - a life-threatening condition in which the immature bowel cannot handle stress brought on by feeding, becomes infected, and dies. Premature infants face a higher risk of developing NEC. When the condition was discovered, Katherine was also battling patent ductus ateriosus - which requires treatment with Indocin ? and being fed increasing amounts of enteral feedings through tubes going through her nose to her stomach. Both the Indocin treatment and enteral feeding put her at increased risk of developing NEC.

According to the court documents, a surgery to treat the condition and prevent her intestinal tissues from failing was not effective, and Katherine died on June 21, 2004.

The Bellerose family?s birth injury lawsuit claimed that those caring for Katherine in the neonatal intensive care unit acted improperly when caring for their daughter because they should have been watching vigilantly for any signs or symptoms of NEC. Jurors found that two members of the staff, Dr. Janet Lloyd and nurse practitioner Michele Ambrosino, were negligent in their care of Katherine. Danielle and John Bellerose were awarded $ 3.5 million each for their loss of the mother-daughter and father-daughter relationship, as well as $ 50,000 for the suffering Katherine experienced before her death.

Lubin & Meyer, an affiliate law firm of Sokolove Law, brought the Bellerose?s lawsuit to Suffolk Superior Court in Boston, Massachusetts and won the verdict. The case (Danielle and John Bellerose v.
